# King of Apps – Terms of Service

## § 1. General provisions

1. These terms of service (the "**Terms**") set out the rules for using the King of Apps website available at https://www.best-apps-for.me (the "**Website**") and the services the Operator provides through it.
2. The Website is a public leaderboard of apps and products ranked only by the amount paid for them. It is intended for both business customers and consumers.
3. These Terms are the terms of service referred to in Article 8 of the Polish Act of 18 July 2002 on the provision of electronic services (the "**Electronic Services Act**").
4. The services are provided by Jędrzej Meder (the "**Operator**").
5. You can contact the Operator:
   1) by email: bestappsforme@proton.me.
6. Under Regulation (EU) 2022/2065 of the European Parliament and of the Council of 19 October 2022 on a Single Market for Digital Services (the "**DSA**"), the Operator has designated a single point of contact for direct communication with the authorities of EU Member States, the European Commission, the European Board for Digital Services and recipients of the service. The point of contact is available at bestappsforme@proton.me and communicates in English and Polish.
7. Before using the Website, and in particular before making a payment, you must read these Terms and the Privacy Policy.

## § 2. Definitions

Capitalised terms in these Terms have the following meanings:

3) **Consumer** – a natural person who enters into a legal transaction with the Operator that is not directly connected with their business or professional activity;

5) **Customer** – a person who pays for a Service; a Customer may be a Consumer, a Sole Trader with Consumer Rights or a Business Customer;
6) **Domain** – the internet domain of the website submitted by the Customer, normalised by the Website (lower case, without "www." and without the path), which identifies a Listing;
7) **Listing** – the entry on the Board for one Domain, consisting of its Listing Content, category, Total and click count;
8) **Listing Content** – the URL, title, description, icon and category of a Listing, whether entered by the Customer or fetched automatically from the website at the Domain;
9) **Listing Service** – the paid service of adding a payment to the Total of the Listing for a Domain, described in § 4(4); it covers both a new Listing and a Top-up;
10) **Non-conformity** – a lack of conformity of a Service with the Contract, assessed under Article 43k(1)–(2) of the Consumer Rights Act;
11) **Payment Provider** – Stripe Payments Europe, Ltd. or another entity that processes payments on the Operator's behalf through a hosted checkout page;

17) **Sponsor Slot** – one of the featured places on the Website marked as a sponsor slot;
18) **Sponsor Slot Service** – the paid service of displaying a Domain in a Sponsor Slot, described in § 4(6);
19) **Sponsor Period** – the period of a Sponsor Slot Service described in § 4(6);
20) **Contract** – a contract for the provision of a Service concluded between the Operator and a Customer or a Visitor under these Terms;

24) **Visitor** – any person who uses the Website without paying, in particular by browsing the Board and clicking Listings.

## § 3. Technical requirements, rules of use and security

1. To use the Website you need:
   1) an internet connection,
   2) a device with an up-to-date web browser,
   3) an email address and a payment method accepted by the Payment Provider, if you want to pay for a Service.
2. The Website does not require an account. A Listing is identified by its Domain, not by the person who paid for it.
3. You must not use viruses, bots, worms or other code, files or programs that interfere with the Website, and in particular you must not use automated scripts to generate clicks, to start checkouts in bulk or to overload the Website.
4. The Operator uses encryption (TLS) and appropriate technical and organisational measures to protect data in transit and to prevent unauthorised access. Despite these measures, using the internet carries risks such as malware or unauthorised access to data on your device. The Operator recommends using anti-virus software and keeping your browser up to date.
5. Browsing the Board is free. The Listing Service and the Sponsor Slot Service are paid.
6. You must provide only true and complete data. The Operator is not responsible for the consequences of incorrect or incomplete data provided by you, in particular a mistyped Domain.
7. You may buy a paid Service only if you are at least 18 years old and have full legal capacity, or act on behalf of a business you are authorised to represent.

## § 4. Contracts for the Services

**Free services**

1. Free of charge, the Operator lets Visitors browse the Board, read the Website's pages, fetch a preview of a website's title, description and icon, and follow the links on Listings. A Contract for these services is concluded when you open the Website and ends when you leave it.

**How the Board ranks Listings**

2. The Board is ranked only by Total, highest first. If two Listings have the same Total, the one that was created earlier ranks higher. The Operator does not use any other ranking parameter, does not take into account quality, popularity, reviews or clicks, and does not accept payment for any other influence on the order. A Rank is not a review, recommendation or endorsement of a Listing.
3. Category pages show the Listings that chose a given category in the order of the global Board.

**Listing Service**

4. In the Listing Service, the Operator adds the amount you pay to the Total of the Listing for the Domain you submit and publishes the Listing on the Board at the Rank that results from its new Total. If the Domain has no Listing yet, the Operator creates one. The Listing Service is performed in full at the moment the Operator adds the payment to the Total.
5. You acknowledge that:
   1) you pay for an amount added to the Total, not for a particular Rank. The Rank and price shown before checkout (for example "Claim #3") are calculated from the Board at that moment. If someone else pays for a Listing while your payment is being processed, your Listing will be placed at the Rank that results from the Totals at the time your payment is added, which may be lower than the Rank shown;
   2) other Customers can pay to move above your Listing at any time, and your Rank will change as a result. This is how the Board works and is not a Non-conformity;
   3) the Operator displays a Listing on the Board free of charge, without a time limit, for as long as the Board operates and the Listing complies with these Terms. The Operator may end the operation of the Board under § 15(6);
   4) any person who pays for a Domain may update its Listing Content during a Top-up, and the Total of a Listing belongs to the Domain, not to the person who paid. If the Domain changes hands, the Listing stays with the Domain.

**Sponsor Slot Service**

6. In the Sponsor Slot Service, the Operator displays your Domain in the Sponsor Slot you choose for a Sponsor Period:
   1) if the Sponsor Slot is free, the Sponsor Period starts when your payment is confirmed and lasts 7 days;
   2) if the Sponsor Slot is taken or booked, the Sponsor Period starts when the last Sponsor Period booked before yours ends and lasts 3 days;
   3) if the last Sponsor Period booked for the Sponsor Slot is for your Domain, it is extended by 3 days instead.
7. Once paid, a Sponsor Period is not shortened by other Customers' payments. Before checkout, the Website shows whether the Sponsor Slot is free and, if it is not, the date on which your Sponsor Period would start. That date is calculated when the form is shown; if another Customer pays for the same Sponsor Slot while your payment is being processed, your Sponsor Period starts after theirs, which is not a Non-conformity.
8. A Sponsor Slot shows the Domain's title, description and icon and links to the Domain. Sponsor Slots and the Board are separate: a Sponsor Slot Service does not change the Total or Rank of any Listing.

**Concluding a paid Contract**

9. To conclude a Contract for a paid Service, you:
   1) enter the website address of your app in the form on the Website and choose the Rank, the amount or the Sponsor Slot,
   2) click the button that starts the checkout (for example "Pay $29", "Bid $29" or "Rent"),
   3) on the Payment Provider's checkout page, enter the required data, confirm that you have read and accept these Terms and the Privacy Policy and, if you are a Consumer or a Sole Trader with Consumer Rights, give the consent and acknowledgement described in § 9(3),
   4) pay the price shown.
10. The Contract is concluded when the Payment Provider confirms your payment to the Operator. The Operator confirms the Contract by email to the address you gave at checkout, together with these Terms.
11. The Operator may refuse to conclude a Contract, or may cancel a checkout and refund the payment in full, if the Domain or the Listing Content clearly breaches the Content Rules, if the Domain was previously removed under § 10, or if the payment appears to be fraudulent.
12. Services are provided in English. Keeping a Service in conformity with the Contract does not require you to install any updates.

**Provisions for Consumers and Sole Traders with Consumer Rights**

13. Paragraphs 14–17 apply only to Customers who are Consumers or Sole Traders with Consumer Rights.
14. If the Operator does not provide a paid Service promptly after the Contract is concluded, you may ask the Operator by email at the address in § 1(5)(1) to provide it promptly. If the Operator does not provide the Service promptly after receiving your request, you may withdraw from the Contract.
15. Regardless of paragraph 14, you may withdraw from the Contract without asking the Operator to provide the Service if at least one of the cases listed in Article 43j(5) of the Consumer Rights Act applies.
16. You withdraw from or terminate a Contract by sending the Operator a statement by email to the address in § 1(5)(1). If you withdraw under paragraph 14 or 15, the Operator refunds the price within 14 days of receiving your statement.
17. After a Contract ends, the Operator stops using the Listing Content you provided, except where the law allows otherwise, and on request makes it available to you free of charge, within a reasonable time and in a commonly used format.

**Removal and termination by the Operator**

18. If a Customer breaches these Terms and does not remedy the breach despite being asked to, the Operator may terminate the Contract with 7 days' notice by email. During the notice period, the Operator may hide the Listing or the Sponsor Slot if that is necessary to stop further breaches.
19. The Operator may remove a Listing or end a Sponsor Period with immediate effect, without prior notice, if the Listing Content or the website at the Domain breaches § 10(2)(1)–(5), or if the Operator is required to do so by law or by a decision of a public authority. The Operator informs the Customer of the removal and its reasons under § 10, where it has the Customer's email address.
20. A Listing Service is performed in full when the payment is added to the Total, so the removal of a Listing under paragraph 18 or 19 does not entitle the Customer to a refund. If a Sponsor Period is ended or cancelled under paragraph 18 or 19, a Business Customer is not entitled to a refund, and a Consumer or a Sole Trader with Consumer Rights is entitled to a refund of the part of the price for the unused days of the Sponsor Period, unless the removal was caused by a breach of § 10(2)(1)–(5).

## § 5. Fees and payments

1. Prices are in US dollars (USD) and are final prices that include any taxes the Operator is required to charge.
2. Payments are made only through the Payment Provider's hosted checkout. The Operator does not receive or store your card details.
3. The date of payment is the date on which the Payment Provider confirms the payment to the Operator. If the Payment Provider reports the payment as pending (for example a delayed bank payment), the Service is provided only after the payment is confirmed.
4. A receipt is sent to the email address you gave at checkout. The Operator issues an invoice on request sent to the address in § 1(5)(1) within the time limits set by tax law.
5. If a payment is reversed, charged back or refunded through the Payment Provider for any reason, the Operator deducts the amount from the Total of the Listing or ends the Sponsor Period. If the Total falls to zero, the Operator removes the Listing. If the reversal is not justified, the Operator may refuse further payments for that Domain.
6. Payments for the Listing Service and the Sponsor Slot Service are final. Refunds are given only where these Terms or mandatory law require them, in particular under § 4(16) and (20), § 7 and § 9.

## § 6. Pricing

1. The current Pricing is published on the Website at https://www.best-apps-for.me/rules. In particular:
   1) a new Listing costs at least $4;
   2) a Top-up is at least $2;
   3) the price of claiming a Rank is $1 more than the Total of the Listing that holds it at the moment of checkout, never less than the minimums in points 1 and 2, and an existing Listing pays only the difference between its Total and that amount;
   4) amounts are whole dollars, up to $100,000 per payment;
   5) the Sponsor Slot Service costs $50 per Sponsor Period.
2. The price of each Service is shown on the Website and on the checkout page before you pay.
3. The Operator may change the Pricing at any time. A change does not affect the price of Contracts concluded before it.

## § 7. Complaints – Consumers and Sole Traders with Consumer Rights

1. This section applies only to Customers who are Consumers or Sole Traders with Consumer Rights.
2. A Service must conform to the Contract throughout the period it is provided.
3. The Operator is liable for a Non-conformity that becomes apparent while the Service is provided.
4. If a Non-conformity becomes apparent, you may file a complaint asking for the Service to be brought into conformity with the Contract.
5. You file a complaint by email at the address in § 1(5)(1).
6. A complaint should include:
   1) your name,
   2) your email address and, if possible, the Domain and the date of payment,
   3) a description of the Non-conformity,
   4) a request to bring the Service into conformity with the Contract.
7. The Operator may refuse to bring the Service into conformity with the Contract if that is impossible or would require the Operator to incur excessive costs.
8. After considering the complaint, the Operator replies and:
   1) accepts the complaint and gives the planned date for bringing the Service into conformity with the Contract,
   2) refuses to bring the Service into conformity with the Contract for the reasons in paragraph 7, or
   3) rejects the complaint as unfounded.
9. The Operator replies by email within 14 days of receiving the complaint.
10. If the Operator accepts the complaint, it brings the Service into conformity with the Contract at its own cost, within a reasonable time from receiving the complaint and without undue inconvenience to you, taking into account the nature of the Service and its purpose.
11. You may submit a statement on a price reduction or on withdrawal from the Contract if:
    1) bringing the Service into conformity with the Contract is impossible or requires excessive costs,
    2) the Operator has not brought the Service into conformity with the Contract under paragraph 10,
    3) the Non-conformity continues even though the Operator tried to bring the Service into conformity with the Contract,
    4) the Non-conformity is so significant that it justifies a price reduction or withdrawal without first asking the Operator to bring the Service into conformity, or
    5) the Operator's statement or the circumstances make it clear that the Operator will not bring the Service into conformity with the Contract within a reasonable time or without undue inconvenience to you.
12. You may not withdraw from the Contract if the Non-conformity is immaterial.
13. You submit a statement on a price reduction or withdrawal by email at the address in § 1(5)(1). It should include your name, email address, the date of the Service, a description of the Non-conformity, the reason under paragraph 11, and either the reduced price or the statement that you withdraw from the Contract.
14. The reduced price must bear the same proportion to the contract price as the value of the non-conforming Service bears to the value of a conforming Service. The Operator refunds amounts due under a price reduction or withdrawal promptly and no later than 14 days after receiving your statement.
15. Under Article 34(1a) of the Consumer Rights Act, if you withdraw from the Contract, you must stop using the Service.

## § 8. Complaints – Business Customers

1. This section applies only to Business Customers.
2. If a Service does not conform to these Terms, a Business Customer may file a complaint by email at the address in § 1(5)(1) no later than 30 days after the non-conformity becomes apparent.
3. A complaint should include the Business Customer's name, email address, the Domain and a description of the non-conformity.
4. The Operator may refuse to bring the Service into conformity with these Terms if that is impossible or would require excessive costs.
5. After considering the complaint, the Operator replies and:
   1) accepts the complaint and gives the planned date for bringing the Service into conformity with these Terms,
   2) refuses to bring the Service into conformity with these Terms for the reasons in paragraph 4, or
   3) rejects the complaint as unfounded.
6. The Operator replies by email within 21 days of receiving the complaint, or within 30 days in particularly complex cases.
7. The Operator's liability to Business Customers under the statutory warranty (rękojmia) is excluded to the fullest extent permitted by law.

## § 9. Right of withdrawal

1. Under Articles 27 et seq. of the Consumer Rights Act, a Consumer and a Sole Trader with Consumer Rights may withdraw from a Contract concluded at a distance without giving any reason within 14 days of concluding it, subject to paragraphs 3–5. The right of withdrawal does not apply to Business Customers.
2. You withdraw by sending the Operator a statement of withdrawal before the 14-day period ends, in any form, for example by email at the address in § 1(5)(1) or using the model withdrawal form in Annex 2 to the Consumer Rights Act. The Operator confirms receipt by email without delay.
3. Paid Services start immediately after payment, before the withdrawal period ends. At checkout, you expressly ask the Operator to start the Service immediately and acknowledge that:
   1) for the Listing Service, which is performed in full when your payment is added to the Total, you lose the right of withdrawal at that moment (Article 38(1)(1) of the Consumer Rights Act);
   2) for the Sponsor Slot Service, you lose the right of withdrawal once the Sponsor Period has ended; if you withdraw before the Sponsor Period starts, you get a full refund, and if you withdraw during it, you pay for the part of the Sponsor Period provided until withdrawal (Article 35 of the Consumer Rights Act).
4. If you withdraw from a Contract while you still have the right to, the Operator refunds the payment, less the amount due under paragraph 3(2), within 14 days of receiving your statement, using the same payment method you used. If you withdraw from a Listing Service, the Operator deducts the refunded amount from the Total of the Listing.
5. If you did not give the request and acknowledgement in paragraph 3 at checkout, you may withdraw within 14 days of concluding the Contract and receive a full refund.

## § 10. Listing Content and notices of illegal content

1. You are solely responsible for the Listing Content, for the website at the Domain and for having the right to promote it. By paying for a Domain, you confirm that you own the website at the Domain or are authorised by its owner to promote it.
2. A Listing, and the website it links to at any time while it is on the Board, must not contain or lead to:
   1) content that is illegal under Polish law, EU law or the law of the place where it is offered,
   2) scams, phishing, malware or impersonation of another person or brand,
   3) adult or sexually explicit content,
   4) content that incites violence or hatred or insults a group of people or a person,
   5) content that infringes personal rights, copyright, trademarks or other rights of third parties,
   6) invite links to Discord, Telegram, WhatsApp or similar group chats,
   7) URL shorteners, affiliate links or redirects that hide the final destination.
3. The Operator may shorten or correct Listing Content to fit the format of the Board, or remove an icon, title or description that breaches paragraph 2, without changing the Total.
4. Anyone (the "**Notifier**") may report a Listing or a Sponsor Slot that they believe contains illegal content or breaches these Terms, by email at bestappsforme@proton.me.
5. A notice should include:
   1) a sufficiently substantiated explanation of why the Notifier considers the content illegal or in breach of these Terms,
   2) a clear indication of the exact location of the content, such as the Domain or the URL of the Listing,
   3) the Notifier's name and email address, except for a notice concerning one of the offences referred to in Articles 3–7 of Directive 2011/93/EU,
   4) a statement confirming the Notifier's good-faith belief that the information and allegations in it are accurate and complete.
6. The Operator confirms receipt of a notice to the Notifier's email address. If a notice is incomplete, the Operator may ask the Notifier to complete it within 14 days; otherwise the Operator may leave it unprocessed.
7. The Operator reviews a complete notice within 14 days of receiving it, may ask the Notifier for further information, and may hide the Listing or Sponsor Slot until the review is finished. The Operator may also review Listings on its own initiative.
8. After the review, the Operator removes or keeps hidden the content that breaches paragraph 2, or restores content that does not, and informs the Notifier and, where it has their email address, the Customer, giving a statement of reasons.
9. The statement of reasons includes:
   1) the decision taken (removal, hiding, shortening of Listing Content, refusal of further payments for the Domain or another measure) and, where relevant, its territorial scope and duration,
   2) the facts and circumstances relied on, including whether the decision was taken on the basis of a notice or on the Operator's own initiative,
   3) whether automated means were used to detect the content or take the decision,
   4) the legal or contractual ground for the decision and an explanation of why the content is considered illegal or in breach of these Terms,
   5) information on how to appeal the decision.
10. A Customer whose Listing was removed or restricted, and a Notifier whose notice was rejected, may appeal by email at bestappsforme@proton.me. The appeal should include the appellant's name, contact details and the reasons why the decision should be changed.
11. The Operator confirms receipt of an appeal by email and decides on it within 14 days. Appeals are decided by a person, not by automated means. The Operator informs the appellant of the decision by email and, if it considers the content illegal or in breach of these Terms, takes the measures provided for in these Terms.
12. By submitting Listing Content, or by submitting a Domain from which it is fetched, you grant the Operator a free, non-exclusive, worldwide licence, for the period during which the Listing is on the Board and 12 months after it is removed, to store, reproduce, shorten and publicly display the Listing Content on the Website, in its machine-readable versions and feeds, and in screenshots and posts promoting the Website. The licence includes the right to let third parties (for example search engines and AI assistants) read and cite the Board.
13. A Business Customer will indemnify the Operator against claims by third parties arising from the Listing Content or the website at the Domain, including reasonable costs of legal assistance, provided that the Operator promptly informs the Business Customer of the claim and lets it take part in the defence.

## § 11. Liability and level of service

1. The Operator provides the Services with due diligence.
2. The Operator does not guarantee any number of clicks, visits, sign-ups, sales or other results from a Listing or a Sponsor Slot, or that a Listing will keep a particular Rank. Click counts on the Website are de-duplicated per Visitor per hour and are shown for information only; they may differ from your own analytics.
3. The Operator does not guarantee uninterrupted availability of the Website. The Operator removes disruptions as far as possible on an ongoing basis and, where possible, carries out maintenance at times that are least disruptive and announces planned maintenance in advance.
4. To the extent permitted by the Polish Civil Code and the Consumer Rights Act, the Operator is not liable for the consequences of:
   1) use of the Website contrary to its purpose or these Terms,
   2) incorrect or untrue data provided by a Customer, in particular a mistyped Domain or a wrong Sponsor Slot,
   3) Rank changes caused by other Customers' payments, or a later start of a Sponsor Period under § 4(7),
   4) changes to a Listing made by another person paying for the same Domain under § 4(5)(4),
   5) the content of websites linked from Listings and Sponsor Slots, which the Operator does not control, review or endorse; Visitors follow such links at their own risk,
   6) disruptions caused by force majeure, including unavailability of the Payment Provider, hosting or database providers, by necessary maintenance, by causes on the Customer's side, or by acts of third parties for whom the Operator is not responsible.
5. To Business Customers, the Operator is not liable for lost profits, and its total liability under all Contracts is limited to the amounts the Business Customer paid the Operator in the 12 months before the event giving rise to the claim. This limitation does not apply to damage caused intentionally.
6. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under mandatory law, in particular towards Consumers.

## § 12. Operator's intellectual property

1. All elements of the Website, in particular its name, logo, graphic design, interface, texts, software, source code and the compilation of the Board as a database, are protected under the Polish Act of 4 February 1994 on copyright and related rights, the Polish Industrial Property Law of 30 June 2000, the Polish Act of 16 April 1993 on combating unfair competition, other generally applicable laws and EU law.
2. Any use of the Operator's intellectual property without the Operator's prior express consent and contrary to these Terms is prohibited. Visitors may read the Board, including through its machine-readable versions, and quote individual Listings with a link to the Website.

## § 13. Out-of-court dispute resolution – Consumers and Sole Traders with Consumer Rights

1. This section applies only to Consumers and Sole Traders with Consumer Rights.
2. You may use out-of-court methods of handling complaints and pursuing claims.
3. Information on these methods and access to them is available at the offices and on the websites of:
   1) district (municipal) consumer ombudsmen and social organisations whose statutory tasks include consumer protection,
   2) the Voivodeship Inspectorates of Trade Inspection,
   3) the Polish Office of Competition and Consumer Protection (UOKiK), at www.uokik.gov.pl.
4. Consumers from other EU Member States may also contact the European Consumer Centre in their country.

## § 14. Personal data

Information on how the Operator processes personal data, including the data processed by the Payment Provider and the data used to de-duplicate clicks, is in the Privacy Policy at https://www.best-apps-for.me/privacy.

## § 15. Changes to the Services

1. Paragraphs 2–5 apply only to Consumers and Sole Traders with Consumer Rights whose Sponsor Period has not ended.
2. The Operator may change a Service where:
   1) it needs to adapt the Service to new devices or software used to access it,
   2) it decides to improve the Service by adding new features or modifying existing ones,
   3) it is legally required to do so, including to adapt the Service to the current law.
3. A change to a Service may not involve any costs for you. The Operator informs you of a change by a notice on the Website and may also inform you by email.
4. If a change significantly and negatively affects your access to a Service, the Operator informs you by email, at least 7 days before the change, of its features and timing and of your right to terminate the Contract with immediate effect within 30 days of the change.
5. You terminate the Contract under paragraph 4 by email at the address in § 1(5)(1). Termination has the same effects as withdrawal from the Contract due to a Non-conformity under § 7.
6. The Operator may end the operation of the Board or of the Sponsor Slots by announcing it on the Website at least 30 days in advance. In that case:
   1) Listing Services already performed are not refunded, as their price covered the amount added to the Total, and display on the Board was provided free of charge under § 4(5)(3),
   2) the Operator refunds every Customer, including Business Customers, the part of the price of the Sponsor Slot Service for the unused days of a Sponsor Period, and the full price of a Sponsor Period that has not started.

## § 16. Changes to the Terms

1. The Operator may change these Terms, in particular where:
   1) the subject of the Operator's business changes,
   2) the Operator starts providing new services, modifies existing ones or stops providing them,
   3) technical changes to the Website require the Terms to be adapted,
   4) it is legally required to do so, including to adapt the Terms to the current law.
2. The Operator publishes the amended Terms on the Website at least 14 days before they take effect and also sends them by email to Customers whose Sponsor Period has not ended at that time, where it has their email address.
3. Contracts concluded before a change are governed by the Terms in force when they were concluded. A Listing Service is performed when it is paid for, so later changes do not apply to it, except for the rules on displaying Listings and on Content Rules, which apply to every Listing on the Board from the date they take effect.
4. A Customer who does not accept the change may terminate the Contract with immediate effect within 14 days of being informed of it, by email at the address in § 1(5)(1). If a Consumer or a Sole Trader with Consumer Rights terminates a Contract for a Sponsor Slot Service on this basis, the Operator refunds the part of the price for the unused days of the Sponsor Period.

## § 17. Final provisions

1. These Terms are in force from 2 November 2026.
2. These Terms and the Contracts are governed by Polish law. For Consumers, this choice of law does not deprive them of the protection afforded by mandatory provisions of the law of the country of their habitual residence.
3. The Operator and the Customer will try to resolve disputes amicably. If that fails, disputes with Business Customers are resolved by the common court having jurisdiction over the Operator's registered place of business. Disputes with Consumers and Sole Traders with Consumer Rights are resolved by the court having jurisdiction under generally applicable law.
4. Matters not covered by these Terms are governed by generally applicable Polish law.
